Montgomery Co. employee accused of leaving job to work out

A Montgomery County employee has been charged with fraud for spending paid work time to exercise at a fitness center, sheriff's deputies said Thursday.
Brian K. Kearns, 39, of Prospect Street, Fultonville, who works for the county Social Services department, was charged with defrauding the government, first-degree falsifying business records and petit larceny, deputies said. Kearns is accused of traveling 25 times during his workday between January and September 2010 to a gym in Fulton County without noting that on time sheets.
The loss to the county was $815, deputies said.
The complaint was filed by the county’s director of personnel and investigators said they cross-referenced Kearns’ pay roll records with gym attendance records.
After arraignment, Kearns was sent to county jail on $1,500 bail.
