HERKIMER, N.Y. —
Prosecutors plan to talk with the sister of a Frankfort woman killed in a collision following a police chase in May before deciding what kind of plea agreement to offer the driver in the deadly crash.
Although Herkimer County Assistant District Attorney Jeffrey Carpenter met with Daniel Conklin’s defense attorney Wednesday to discuss the parameters of a possible sentence, Carpenter said no specific agreement has yet been reached.
Conklin, 24, of Rochester, is currently facing 15-charges including second-degree manslaughter, unlawfully fleeing a police officer and second-degree assault in connection to a May 24 collision along Route 5 in Schuyler that killed Gail Pietruska, 65, and injured her sister, Louise Medallis, 54.
If convicted of second-degree manslaughter as a second felony offender, Conklin could face up to 7 to 15 years in prison, Carpenter said.
But before any decision is made on what offer to extend Conklin, Carpenter said it would only be fair to first sit down with the surviving Medallis in the next week or so and listen to hear input.
Because Conklin was on parole at the time of crash, Conklin’s attorney, Donald Manley, also wants to talk with the state Division of Parole to determine if any prison time for violating his parole would run consecutive to a prison sentence for Pietruska’s death, Carpenter said.
Conklin’s next proceeding in Herkimer County Court is scheduled for Monday, Sept. 24.
