Herkimer village police arrested two individuals after responding to a report of a burglary in progress.
Police were called to Desperado Western Wear, 103 S. Main St., Herkimer, on Aug. 4 at 4:23 a.m., where one of the large display windows had been broken.
A witness reported seeing two males fleeing the area with several items from the store, police said.
Shortly after, patrols observed two men in the King Street area of the village, with one of the individuals wearing a white cowboy hat, said police, adding the two men fled when they observed the patrol car approaching. Officers chased the suspects by foot and quickly apprehended one behind a residence on Eureka Avenue, police said. This individual was identified as Steven Guyer, 21, of Herkimer, who was allegedly found with stolen property on his person at the time of his arrest.
Guyer was charged fifth-degree criminal possession of stolen property.
He was ticketed and released, police said.
Police later located Andrew J. Bennett, 22, of Herkimer. He was charged with third-degree burglary, two counts of third-degree criminal mischief, fourth-degree criminal mischief, third-degree criminal trespass, fourth-degree grand larceny and trespass. He was arraigned and sent to Herkimer County jail in lieu of $10,000 cash bail or $20,000 bail bond, police said.
Police said the investigation is continuing and more charges are possible.
