A Herkimer woman has been charged in connection with the Oct. 13 case in which a dozen dogs were found malnourished in the yard of her residence, state police said.
Barbara A. Smith, 65, of state Highway 28, was charged with 12 counts of failure to provide sustenance under the New York State Agricultural and Markets Law, a class A misdemeanor, which is the most severe class.
Smith was arraigned Friday in Herkimer Town Court by Judge Michael Petucci and released on own recognizance until her 1:30 p.m. court date on Dec. 10.
Additionally, she was charged by town of Herkimer dog control officer Kimber Elthorp for 12 counts of not having a licensed dog and 12 counts of not having rabies vaccinations.
The dogs continue to be cared for by the Herkimer County Humane Society.
