By Rocco LaDucaGateHouse New YorkHERKIMER — If David Pope hadn’t overreacted one night in April, then perhaps he wouldn’t have been shot by a state trooper and now heading to prison again, his attorney said.Pope, 33, of West Winfield, was sentenced Tuesday in Herkimer County Court to five years in prison as a second violent felony offender after pleading guilty to menacing a police officer with a knife.Pope will also face five years of post-release supervision.
